Purpose: Approving GEO no. 120/2020 on establishment of support measures for employees and employers in the context of the epidemiological situation caused by the spread of the SARS-CoV-2 coronavirus

Purpose: Amending GEO no. 110/2017 on the Support Program for SME – SME INVEST ROMANIA.

Main measures:

  • the budget of the state aid scheme is RON 1,832 million, the RON equivalent of approximately EUR 376.3 million;
  • the ceiling of the total guarantees that can be granted within the program is RON 15,000 million, out of which RON 1,000 million for the AGRO IMM INVEST Subprogram for the year 2021;

Purpose: Extending the alert status on the Romanian territory from an additional period of 30 days starting with 14 March 2021, as well as establishing the measures applied during such period to prevent and combat the effects of the COVID-19 pandemic.

Order 3459/280/2021 Of Minister Of Education And Minister Oh Health

Purpose: Amending Order no. 3235/93/2021 of Minister of Education and of Minster of Health for establishing organization measures for the activity within educational units/institutions under epidemiological safety conditions for the prevention of SARS-CoV-2 virus diseases.

Main measures:

  • operating scenario of the educational unit/institution during the school/university year will be updated weekly depending on the epidemiological evolution;
  • the activities that require the physical presence of preschoolers and students in the educational units are not allowed, and the didactic activity is carried out exclusively online in the localities where the zonal quarantine measure is established;

the protective mask is compulsory for primary, secondary and high school students, as well as for students, and will be worn in classrooms, while moving around on the school premises and during breaks, both indoors and outdoors.

Government Emergency Ordinance No. 12/2021

Purpose: Amending Law no. 95/2006 on health care reform

Main measures:

  • establishing new attributions for the boards of directors of public hospitals, such as approving direct acquisitions exceeding the value of RON 50,000 and the right to propose an external audit on all activities carried out in the hospital.
  • introducing the possibility for the Minister of Health to grant from the Minister’s reserve humanitarian aid free of charge or as donations to institutions or authorities with responsibilities in the health field in other states, consisting of drugs, serums, vaccines, disinfectants, insecticides, medical devices, assistive technologies and devices and other specific materials, in order to prevent or resolve emergencies arising from epidemics, pandemics, disasters or natural disasters;

Purpose: Approving the list of countries/areas/territories with a high epidemiological risk for which the quarantine measure is established on every person arriving in Romania from them, establishing rules for the application of quarantine measures and exceptions thereto.

  • updating the list of countries/areas/territories with a high epidemiological risk;
  • introducing the quarantine exception for people vaccinated against the SARS-CoV-2 virus, with the second dose included and for which at least 10 days have elapsed

Order No. 20/2021 Of The Ministry Of Defense

Purpose: Approving the Methodological Norms on granting the salary increase provided in art. 4 par. (3) of the GEO no. 147/2020 on granting days off for parents in order to supervise children, in case of limitation or suspension of teaching activities that involve the actual presence of children in schools and early childhood education units, following the spread of SARS-CoV-2 coronavirus.

Purpose: Organization measures for the activity within educational units/institutions under epidemiological safety conditions for the prevention of SARS-CoV-2 virus diseases.

Main measures:

  • introducing the procedures and compulsory measures for the prevention and control of SARS-CoV-2 virus diseases to be applied in pre-university/related educational establishments/educational institutions, in order to ensure the right to education and the right to health for the primary beneficiaries, students and staff in the national education system;
  • the same procedures and measures apply while engaged in educational and recreational activities, for reinforcing students’ skills or accelerating the learning process, as well as while engaged in remedial learning activities carried out with the physical presence in educational establishments within the “School after School” programs.

Government Emergency Ordinance No. 226/2020

Purpose: Establishing fiscal-budgetary measures, amending certain normative acts and extending certain legal deadlines.

Main measures:

  • extending until 31 March 2021 the deadlines for submitting:
    • the application for the simplified rescheduling of the fiscal obligations according to GEO no. 181/2020
    • the application for the annulment of ancillary obligations
    • the refund period with subsequent control of VAT (with certain exceptions)
  • establishing the computation method for the taxes and social contributions due by individuals benefiting from the support allowance according to GEO no. 30/2020;
  • introducing a VAT exemption with the right of deduction in the case of deliveries of vaccines and devices for the diagnosis of COVID-19, as well as in the case of vaccination and related testing services.

Government Emergency Ordinance No. 220/2020

Purpose: Establishing social protection measures after 1 January 2021 in the context of the pandemic of Covid-19, for example, measures to support employers and employees. Such as:

  • Employers shall benefit for a period of 12 months of a monthly indemnity of 50% of the employees’ income, but not more than 2,500 lei, for each employee from specific categories they hire between 1 January 2021 and 1 September 2021 for an indefinite period, full time. Employers who terminate the individual employment contracts earlier than 24 months must fully reimburse the received amounts, plus interest;
  • Employers may be granted, at their choice, the reimbursement of 41.5% of the received income from the unemployment insurance budget, but no more than 41.5% of the national average income, for up to 3 months until 30 June 2021, for the employees that conclude individual employment contracts for a fixed period of up to 3 months.

Law No. 282/2020

Purpose: Approving GEO no. 132/2020 on support measures for employees and employers in the context of the epidemiological situation caused by the spread of the SARS-CoV-2 coronavirus, as well as to stimulate employment growth.

Main measure:

  • Extension of the time during which employers can apply reduction of work time until the expiry of 3 months from the end of state of emergency/state of alert;
  • Interdiction for the employer to hire staff to perform activities identical or similar to those performed by employees whose working time has been reduced, as well as to subcontract related activities at the level of subsidiary, branch or other secondary offices;
  • employers whose employees have worked at least 15 working days in telework during the state of emergency or of alert are entitled to a financial support of RON 2,500 granted to employers for each teleworker for acquiring telework related goods or services.

Government Decision No. 1046/2020

  • suspension of school activities involving physical presence of pre-schoolers and students during the period 9 December 2020-23 December 2020.

Government Emergency Ordinance No. 211/2020

Purpose: Extending the application of certain social protection measures adopted in the context of the spread of the SARS-CoV-2 coronavirus, as well as modification of GEO no. 132/2020 on support measures for employees and employers in the context of the epidemiological situation caused by the spread of the SARS-CoV-2 coronavirus, as well as to stimulate employment growth.

Main measures:

  • The measures provided under art. XI and XV of GEO no. 30/2020 are extended until 30 June 2021, in all the all fields of activity provided by Law no. 55/2020;
  • If the employer’s activity was suspended following an epidemiological review by the local public health directorates, employees are entitled to an indemnity during the entire period in which the activity is suspended, until maximum 30 June 2021;
  • employers may reduce the employees’ salary by up to 80% of the monthly duration, after prior information and consultations with the syndicate / employees’ representatives / employee.

Main measures: Extension by 9 months from the entry into force of the emergency ordinance of the following measures introduced by GEO no. 70/2020 regarding regarding the activity of the National Office of the Trade Register:

  • the activity of the trade registry is carried out mainly by electronic means/by correspondence;
  • the affidavits that are annexed to the registration application / other applications may have the form of a private deed or electronic form and may be submitted with the trade registry, without any other formality, by electronic means, with the electronic signature attached or by mail and courier;
  • the signature specimen is submitted with the trade registry either legalized by the notary public, certified by a lawyer or in the form of a private deed or can be given at the trade registry.

  • Suspension of the activity of closed agri-food markets, fairs, mixed flea markets, with the exemption of agri-food markets that can be organized in open public areas;

Purpose: Extension of the deadlines for the submission of documents provided for by associations and foundations, as well as legal persons registered with the trade register.

Main measure:

  • The deadline for submitting the ultimate beneficiary owner statement for companies as well as that for associations and foundations was extended to 90 days from the end of the alert state;
  • The ultimate beneficiary owner statement may be submitted in the form of a document under private signature or under electronic form and may be sent to the trade register office by electronic means, with electronic signature, or by postal and courier services.

Government Emergency Ordinance No. 181/2020

Purpose: Fiscal and budgetary measures and extension of certain deadlines.

Main measures:

  • Approval of the rescheduling for a period of up to 12 months of main and ancillary fiscal obligations matured after the state of emergency was declared and unsettled by the issuance of the fiscal certificate, managed by the tax authority, under certain conditions;
  • Expenditures on the equivalent of COVID-19 diagnostic medical tests, performed for carrying out the activity, in order to detect and prevent the spread of the virus, will be deductible when calculating the net income from independent activities determined in the real system;
  • The equivalent value of the expenses incurred by the employer/payer for COVID-19 diagnostic medical tests performed at the initiative of the employer for the detection and prevention of coronavirus for its employees will not represent taxable income and will not be included in the monthly calculation of social insurance contributions;
  • The period in which no interest and penalties will be calculated for debts due staring with 21 March 2020, and in which enforcement is suspended or is not to commence, was extended until 25 December 2020;
  • The deadline for the VAT refund with subsequent control was extended until 25 January 2021.

  • prolongation of suspension of the consumption of food and alcoholic and non-alcoholic beverages in common dining areas of restaurants, hotels, motels, boarding houses, cafes, or other public places;

  • employees affected by the measure shall receive wage rights due for the actual time worked as well as an indemnity of 75% of the difference between the gross basic salary provided in the individual employment contract and the gross basic salary for the hours actually worked;
  • the indemnity is borne by the employer and is will be settled from the unemployment insurance budget;
  • the hiring of staff for the performance of activities identical or similar to those performed by employees whose working time has been reduced, as well as the subcontracting of activities carried out by employees whose working time has been reduced, are prohibited.

Order No. 721/2020 Of The Competition Council

Purpose: Implementation of the Regulation on amending and supplementing the Regulation on the conduct of hearings and the adoption of decisions within the Competition Council, implemented by the Order of the President of the Competition Council no. 509/2015

Main measures:

  • The regulation makes changes to the procedure for videoconferencing hearings.
  • During the state of emergency or alert or if it is necessary to ensure social distance or in other situations, the President of the Competition Council may order the organization of hearings by videoconference.
  • The hearings will be organized by videoconference as follows:
  1. if the investigated parties have the technical means necessary to make the electronic connection, they shall ensure the connection in order to be in permanent contact with the competition authority. If the parties ensure their own connection, they shall bear the risks related to the means used to connect to the competition authority’s platform, including but not limited to interrupting the electronic connection or unauthorized access to it, without subsequently being able to invoke these issues against the competition authority;
  2. if the investigated parties do not have the necessary technical means to make the electronic connection, their access by videoconference will be made with the equipment of the Competition Council, for which purpose it will provide a room.
  • Plenary members may attend the hearings via the videoconferencing system.
  • Undertakings, their representatives and other participants undertake not to make parallel recordings of the meeting before the start of the hearings.
  • When the hearing takes place by videoconference, the parties have an obligation to ensure that other unauthorized third parties are not allowed to access the hearing, including by providing the data for connection to the videoconference or by other means. Each company will send the list of persons authorized to attend the hearing on its behalf, as well as their identification data.

  • grants for productive investments granted from non-reimbursable external funds based on the evaluation of the submitted investment project in an amount between 50.000 and 200.000 for SMEs,
  • between 1 August and 15 September 2020, MEEMA issues emergency certificates, upon request, to economic operators whose activity has been affected in the context of the COVID-19 pandemic during the state of emergency.
